1.1   Welcome to the website of Ballet Class Ltd ("Ballet Class", "we", "us", "our"), a platform for ballet lovers and fitness enthusiasts, offering a range of ballet, Pilates, and workout class videos recorded by professional dancers from around the world. The content is designed for your personal training use, or simply for you to watch and enjoy. We are a company registered in England and Wales with company number 13070946, with our registered office at 71–75 Shelton Street, London, WC2H 9JQ.

 

1.2   The following terms and conditions ("Terms") govern your access to and use of www.balletclass.com and the balletclass.com online store at www.shop-balletclass.com (together, the "Website"), including all content, functionality, and services offered through the Website ("Services"), whether as a guest or a subscribed user. PLEASE READ THESE TERMS CAREFULLY BEFORE YOU START TO USE THE WEBSITE OR SERVICES. BY ACCESSING THE WEBSITE OR USING THE SERVICES, YOU AGREE TO BE BOUND BY THESE TERMS.

 

1.3   Please also read our Privacy Policy, which governs your use of the Website and Services. We will not use your personal data or cookies in a way that is inconsistent with the purposes and limitations set out in our Privacy Policy.

 

1.4   This Website is available to users who are 18 years of age or older, or to users aged 13 and over with the consent of a parent or guardian. By using this Website, you confirm that you meet these eligibility requirements. Users aged 13 to 17 may only use the Website with the consent of a parent or guardian, and only where a parent or guardian has taken out a subscription on their behalf. If you do not meet these requirements, you must not access or use the Website.

2. Changes to the Terms

2.1   We may update or modify these Terms from time to time. All changes take effect immediately when posted. We recommend that you review these Terms regularly. Where changes are material, we will endeavour to notify you by email.

 

2.2   If you do not agree to the updated Terms, please stop using the Website. Your continued use of the Website following any update constitutes your acceptance of the revised Terms.

3. Your Account and Use of the Service

3.1   The Service and all content available through the Website is provided solely for your personal, non-commercial use. You may not copy, reproduce, publish, transmit, distribute, display, modify, create derivative works from, sell, or otherwise exploit any content or any part of the Service for any commercial purpose or in competition with our business.

 

3.2   You must create an account to access the Service. Please note that a separate account is required to use the balletclass.com online store at shop-balletclass.com. Keep your password safe and secure — you are responsible for all activity that occurs through your account. You must not share, sell, transfer, or assign your account or login credentials to any other person.

 

3.3   When creating and maintaining your account, you must provide accurate and complete information, including a valid email address. You must not solicit, collect, or use the login credentials of other users.

 

3.4   If we discover that your account has been created or used in violation of these Terms, we may terminate it. Please notify us immediately at support@balletclass.com if you believe someone else has accessed your account without your permission.

 

3.5   Additional terms apply if you are purchasing a subscription as a gift for another person. Please refer to the Appendix.

4. Prohibited Uses

4.1   You may use the Services only for lawful purposes and in accordance with these Terms. You agree not to use the Website:

 

(a)   In any way that violates any applicable local, national, or international law or regulation;

(b)   To impersonate any person or entity, or to misrepresent your identity or affiliation with any person or entity;

(c)   To exploit, harm, or attempt to exploit or harm minors in any way;

(d)   To transmit any unsolicited or unauthorised advertising or promotional material, including spam or chain letters.

 

4.2   You also agree not to:

 

(a)   Use the Website in any manner that could disable, overburden, damage, or impair it, or interfere with any other user's access;

(b)   Use any automated tools, bots, or scraping technology to access or copy any material from the Website;

(c)   Use any software or device that interferes with the proper working of the Website;

(d)   Introduce any viruses, malware, Trojan horses, worms, or other harmful or malicious code;

(e)   Attempt to gain unauthorised access to any part of the Website, its servers, or any connected systems or databases;

(f)   Subject the Website to a denial-of-service or distributed denial-of-service attack;

(g)   Provide us with the name or email address of any third party without their authorisation.

5. Membership Plans

5.1   We currently offer the following membership plans, details of which are set out on the Website:

 

•       Monthly (Soloist) Membership: A monthly rolling subscription giving full access to all platform content. No free trial is included.

•       Yearly (Soloist) Membership: An annual subscription giving full access to all platform content, including a 3-day free trial.

•       Student Membership: An annual subscription available exclusively to vocational ballet school students at a discounted rate, including a 3-day free trial. Proof of student status is required.

•       Teachers Membership: An annual subscription for educators, which includes a unique discount code to share with students. The discount code is only valid while the Teachers subscription remains active.

•       Principal Membership: An annual subscription including full platform access plus personal mentorship from balletclass.com directors Xander Parish and Anastasia Demidova, comprising two hours of live one-to-one coaching via Zoom and written targets, corrections, and feedback. Coaching is allocated on availability and commences at the start of the paid subscription period.

 

5.2   We reserve the right to modify, introduce, or withdraw membership tiers at any time. Any changes to your existing plan will be communicated to you in advance.

6. Payments, Billing, Cancellations and Refunds

6.1   Subscriptions.   All subscriptions are purchased through the Website for your personal use, or as a gift for another person. All purchases are governed by these Terms. Your subscription term begins on the date your payment is received or, if you are a gift recipient, on the date your redemption link is activated.

 

6.2   Free Trials.   Where a free trial is offered, you may cancel at any time during the trial period without charge. If you do not cancel before the trial period ends, your paid subscription will begin automatically and the applicable fee will be charged.

 

6.3   Student Membership — Proof of Status.   The Student Membership is available exclusively to vocational ballet school students. Proof of student status will be requested. If you fail to provide satisfactory proof, you will be charged the full Yearly Membership rate upon expiry of your free trial.

 

6.4   Teachers Membership — Discount Code.   Upon purchase of the Teachers Membership, you will receive a unique discount code to share with your students. This code entitles students to a 50% discount on the Yearly Membership. The discount code is only valid while your Teachers Membership remains active. If your subscription lapses or is cancelled, the code will be deactivated and any students who have not yet redeemed it will no longer be able to do so at the discounted rate.

 

6.5   Principal Membership — Coaching.   The Principal Membership includes two hours of live one-to-one coaching via Zoom with Xander Parish or Anastasia Demidova, allocated based on availability. We will endeavour to accommodate any preference you may have. We will be in touch during your free trial period to discuss your goals and agree a plan. Coaching sessions will not commence until your paid membership begins.

 

6.6   Automatic Billing.   By subscribing, you authorise us to charge the payment method you have provided on a recurring basis at the applicable interval (monthly or annually) until you cancel. Your subscription will continue indefinitely unless cancelled in accordance with section 6.7.

 

6.7   Cancellation.   You may cancel your subscription at any time by visiting your account page and following the cancellation steps. If you cancel before the end of your current billing period, you will retain access to the Service until the end of that period. No refund will be issued for any unused portion of your subscription, subject to section 7.3.

 

6.8   Non-Refundable Payments.   Subject to section 7.3, all subscription fees are non-refundable. No refund will be made for partially used periods or where you choose not to use the Service.

 

6.9   Payment Methods.   We accept Apple Pay, Google Pay, PayPal, and credit and debit cards, along with any other payment methods we may introduce from time to time. Payments are processed by Stripe (stripe.com), a third-party payment provider. By making a payment, you agree to Stripe's terms and conditions. We do not store your full card details.

 

6.10   Failed Payments.   If we are unable to process a payment through your chosen payment method, or if a chargeback is raised and granted, we may suspend or terminate your subscription. If you continue to access the Service following a failed payment, you remain liable for the corresponding fees and must settle any outstanding amounts within 10 days of notification from us.

 

6.11   Price Changes.   We reserve the right to change our pricing at any time. You will be notified in advance of any price change affecting your subscription. Your continued use of the Service after a price change takes effect constitutes your acceptance of the new price.

 

6.12   Billing Queries.   If you believe you have been charged incorrectly, please contact us promptly at support@balletclass.com.

7. Problems with the Service

7.1   If you have any questions or complaints about the Service, please contact us at support@balletclass.com.

 

7.2   We are under a legal duty to supply digital content that conforms to this contract. Nothing in these Terms affects your statutory rights.

 

7.3   UK Consumer Rights.   Under the UK Consumer Rights Act 2015, digital content must be as described, fit for purpose, and of satisfactory quality. In summary:

 

(a)   If the digital content is faulty, you are entitled to a repair or replacement;

(b)   If the fault cannot be fixed within a reasonable time and without significant inconvenience, you may be entitled to a full or partial refund;

(c)   If faulty digital content damages your device and this results from our failure to use reasonable care and skill, you may be entitled to a repair or compensation.

 

7.4   For customers outside the United Kingdom, your local consumer protection laws may provide additional rights. Please consult the relevant consumer advice body in your jurisdiction.


8. Health Warning, Disclaimer, and Limitation of Liability

8.1 Health and Safety Warnings

HEALTH WARNING.   You should consult your doctor or healthcare professional before participating in any dance or exercise programme. Nothing on this Website constitutes medical advice. You should not participate in any classes if you have a history of heart disease, high blood pressure, high cholesterol, chest pains during exercise, are currently pregnant, or have been advised by a doctor to avoid the type of activity shown. By participating in any class, you acknowledge that there is an inherent risk of personal injury and, subject to section 8.4, you assume responsibility for that risk.

 

EXERCISE ENVIRONMENT.   We strongly recommend that you: (i) assess the space in which you intend to exercise and ensure it is clear of hazards; (ii) ensure you have sufficient room to participate safely; and (iii) wear appropriate clothing and footwear. Subject to section 8.4, Ballet Class accepts no liability for loss, injury, or damage arising from your failure to properly assess your environment or equipment.

 

PARENTAL RESPONSIBILITY.   If a child is participating in any class, their parent or guardian takes full responsibility for their safety.

8.2 Disclaimer of Warranty

YOUR USE OF THE WEBSITE IS AT YOUR OWN RISK.   The content and Services are provided on an "as is" basis. We make no warranties of any kind — express or implied — including warranties of suitability, reliability, availability, accuracy, or fitness for a particular purpose. We do not warrant that you will achieve any particular result from use of the Services.

8.3 Exclusion of Liability

Subject to section 8.4, we will not be liable for any damages arising from your use of the Website or Services, including direct, indirect, incidental, punitive, or consequential damages.

8.4 Limitation of Liability

(A)   Cap on liability.   Where we are found liable to you, our aggregate liability shall not exceed the lesser of: (i) the fees paid by you in the six months prior to the claim; or (ii) £100 (or the equivalent in your local currency).

 

(B)   Liability we cannot limit.   Nothing in these Terms limits our liability for: death or personal injury caused by our negligence; fraud or fraudulent misrepresentation; breach of your statutory rights under applicable consumer protection law; or any other liability that cannot be excluded by law.

 

(C)   Device damage.   If defective digital content we have supplied damages your device, and this is caused by our failure to use reasonable care and skill, we will repair the damage or pay you appropriate compensation.

 

9. Intellectual Property and Licence

9.1   All content on the Website and within the Service is owned by or licensed to Ballet Class. It is protected by copyright, trademark, and other intellectual property laws. Ballet Class retains all rights in the content and the Service.

 

9.2   We grant you a limited, personal, non-exclusive, non-transferable licence to access and view the content you have paid for, solely for your personal, non-commercial use in accordance with these Terms. All other uses are prohibited.

 

9.3   By creating an account, you grant Ballet Class a non-exclusive, irrevocable, royalty-free, worldwide licence to use the information you submit (such as your name) for the purposes of providing the Service.

10. Termination

10.1   We may suspend or terminate your account at any time if we believe you have violated these Terms or engaged in fraudulent, abusive, or illegal activity. We may also discontinue the Service or any part of it at any time, with or without notice.

 

10.2   Upon termination, your access to the Service will cease. No refund will be issued for accounts terminated due to a breach of these Terms. We may refer suspected illegal activity to the relevant authorities.

11. Third Party Links

11.1   The Website may contain links to third party websites. These links are provided for your convenience only. We have no control over the content of those sites and accept no responsibility for them or for any loss or damage arising from your use of them. You access third party websites entirely at your own risk.

12. Governing Law and Jurisdiction

12.1   These Terms and any dispute arising from them (including non-contractual disputes) shall be governed by and construed in accordance with the laws of England and Wales.

 

12.2   We will generally bring any legal proceedings in the courts of England and Wales, though we retain the right to bring proceedings against you in the courts of your country of residence. You consent to the jurisdiction of the English and Welsh courts for any proceedings brought by us.

 

12.3   If you are resident in Scotland or Northern Ireland, you may bring proceedings in your local courts. If you are resident in another jurisdiction, you may have the right to bring proceedings in your country of residence.

 

13. General

13.1   No failure or delay by us in exercising any right under these Terms shall constitute a waiver of that right.

 

13.2   If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

 

13.3   Nothing in these Terms creates any joint venture, partnership, employment, or agency relationship between you and Ballet Class.

 

13.4   You may not assign or transfer your rights under these Terms. We may assign our rights without restriction.

 

13.5   These Terms, together with our Privacy Policy, constitute the entire agreement between you and Ballet Class in relation to the Website and Services.

Appendix — Additional Terms for Gifted Subscriptions

These Gift Terms and Conditions (this "Agreement") apply to the purchase and redemption of gifted subscriptions ("Gifts") from Ballet Class Limited. They apply alongside and incorporate the Terms of Service above. You accept this Agreement when you purchase or redeem a Gift on www.balletclass.com.

 

1. Purchasing a Gift

You will be charged immediately upon purchase at the price shown at checkout. We do not offer price matching if the price changes after purchase. You must designate a single recipient using their email address. A redemption code will be sent to the recipient by email immediately after purchase, unless you select a future delivery date (available up to one year from the purchase date).

2. Redeeming a Gift

To redeem a Gift, the recipient must have a valid email address. Redemption codes are single use and may only be redeemed once. We are not responsible if a code is lost, stolen, used without your permission, or expires before redemption. The recipient's ability to use the Gift may depend on certain technical requirements, including internet access. Gifted content is for personal and lawful use only.

3. Minors

Gifts to users aged 13–17 are subject to parental or guardian consent. Please refer to the main Terms of Service for further information.

4. Returns and Refunds

A Gift may be cancelled and refunded to the purchaser within 14 days of purchase, provided it has not yet been redeemed by the recipient. Once redeemed, the Gift is non-refundable. Gift recipients are not entitled to a refund or cooling-off period, except as required by applicable law.

5. Subscription Duration

Gifted subscriptions are valid for the subscription period specified at the time of purchase. Upon expiry, the recipient will have the option to continue their subscription at the then-current price. If they choose not to continue, their access will end at the expiry of the gifted period.

7. Suspension and Termination

If you violate the terms of this Agreement, we may suspend or terminate your ability to purchase or redeem Gifts, or access your balletclass.com account. Gifts and redemption codes have no cash value, are not eligible for resale, and are void where prohibited by law.
